Pilgrim Packs offers this website, including all information, tools and services available from this website to you conditioned upon your acceptance of all terms, conditions, policies and notices stated herein. 

By visiting our website or purchasing a product from us through the website, you engage in our “Service” and agree to be bound by these Terms, including any additional terms and conditions and policies referenced herein or available by hyperlink.

We reserve the right to update, change or replace any part of these Terms at our discretion without notice. Please read these Terms carefully each time before engaging in the Service. By engaging in the Service, you agree to be bound by the latest version of these Terms, which are made available here. If you do not agree to be bound to these Terms, then you must discontinue engaging in the Service. We reserve the right to refuse the Service to anyone for any reason at any time. A breach of any of the Terms may result in an immediate termination of the Services.

SECTION 1 - ELIGIBILITY

By agreeing to these Terms, you represent that you are the age of majority (and not a minor) in your state or territory. If you are engaging in the Service on someone else’s behalf, you represent that you have the authority to bind that person as the principal to these Terms, and to the extent you do not have such authority, you agree to be bound to these Terms and to accept responsibility and liability for any use of the Service.

SECTION 2 - PRICING, SHIPPING AND REFUNDS

All prices shown on the website are in Australian dollars and inclusive of GST. Prices are subject to change effective immediately upon notice, which may be provided by updating the prices on the website. Despite our best efforts, products on our website may inadvertently be priced incorrectly. Should we discover an error in the price of one or more of our products that you have ordered before your order is confirmed, we will notify you and provide you the option of continuing with your purchase at the correct price, or cancelling your order.

We take great care in selecting our products, suppliers, and partners, including our shipping partners. However, products may suffer damage during transport. Should our product(s) be damaged during transport to you, we will provide you with a replacement product. Requests for replacement products must be made within 5 business days of receipt of the damaged product, reasonable evidence of the damage must be provided, and the product(s) must be returned in unused condition.

In the unfortunate event that you react to one our products, we will offer you a refund of the affected product, subject to you providing reasonable evidence of the reaction to our product within 10 business days of receipt of the product, and provided the affected product(s) are returned to us.

All requests for replacements or refunds must be sent to us by email at charli@pilgrimpacks.com. Products must be returned to: Pilgrim Packs, 234 Manns Road, Langley VIC 3444, Australia. We do not reimburse or refund shipping costs. We recommend using a trackable shipping service to track your return shipment to us.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION 

Whilst we make every effort to depict our products as accurately as possible, images of our products displayed on our website are for illustrative purposes only. We cannot guarantee that your computer’s display of the colours accurately reflect the colour of our products, and our products (including its packaging) that you receive may vary slightly from the images depicted on our website. To the extent permitted by law, we do not warrant that the product or the Service descriptions, colours, information or other content available on our website are accurate, complete, reliable, current, or free from errors.

The travel industry is a heavily regulated industry, and its regulations are subject to change. Whilst we make every effort to be current with our products and information about travel (including its regulations and restrictions), information on this website is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. To the extent permitted by law, we are not responsible if information or our products are not accurate, complete, or current, and any reliance on our information or products is at your own risk.

All descriptions of products or product pricing are subject to change at any time without notice. We reserve the right to refuse any order you place with us, or limit or cancel such orders. You agree to use our products and the Services only for their intended purpose. 

 We are a retailer, and not the manufacturer of the products we sell on our website. Our products come with guarantees that cannot be excluded by law, including Australian Consumer Law, with which Pilgrim Packs and the Service complies. These Terms do not limit or exclude your rights that cannot be limited or excluded under Australian Consumer Law.

SECTION 5 - ACCURACY OF BILLING AND ACCOUNT INFORMATION 

You agree to provide current, complete and accurate personal, address, payment, and other requested information when purchasing a product. By entering your payment details you represent that the payment details you provide are valid and accurate, and that you are authorised to provide this information.

SECTION 6 - THIRD PARTY CONTENT 

Content on our website may include information or materials from third parties, or include links to third party websites that are not affiliated with us. We are not responsible for the content or accuracy of such information or materials provided by third parties or through their websites. 

SECTION 7 - USER FEEDBACK

Feedback, ideas, suggestions, proposals, plans, or any other information (“User Feedback”) that you send us will automatically become our property, and may be used, edited, copied, published, distributed, translated and otherwise used by us in any medium for any purpose (including for commercial use) without any obligation of confidentiality or compensation to you. You represent and warrant that your User Feedback will not violate the right of any third party, including copyright, trademark, privacy, or other personal or proprietary right.

Our liability for losses or damages is excluded to the maximum extent permitted by law. Our liability for losses or damages that cannot be excluded by applicable law (including under the Competition and Consumer Act 2010 (Cth)) is, to the maximum extent permitted by law, limited to, at our option: replacing a product or products; resupplying an equivalent product or products; repairing the product or products; or providing payment of the cost of replacing the product or acquiring an equivalent product, or having the product repaired.

You agree to indemnify, defend and hold harmless Pilgrim Packs, its trust and its trustees, and its directors, officers and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Service, any breach of these Terms and the terms of any documents they incorporate by reference, or your violation of any law or any rights of any third party. 

SECTION 11 - SEVERABILITY 

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity or enforceability of the remaining provisions.

These Terms are effective unless and until terminated. Any rights or obligations intended to survive termination shall so survive.

If you breach, or we suspect that you have breached or will breach any provision of these Terms, we may terminate the Services at any time by providing notice to you.

These Terms and any separate agreements whereby we provide you Services shall be governed by the laws of the State of Victoria, Australia.

SECTION 16 - GIFT CARDS

1. Pilgrim Packs gift cards (“Gift Cards”) entitle its holder to purchase Pilgrim Packs products equal to the value stated on the Gift Card (or the value remaining after partial redemption) through the Pilgrim Packs website.

2. The value shown on a Gift Card includes GST.

3. Gift Cards are not redeemable for cash or other Gift Cards.

4. Gift Cards are partially redeemable and any unused balance will remain on the Gift Card.

5. If the Gift Card holder's order exceeds the amount of the Gift Card, the Gift Card holder will be required to pay for the difference in price between the value of the Gift Card and the retail price of the product(s).

6. Gift Cards can be redeemed at any time until its expiry date.

7. Pilgrim Packs may refuse to redeem a Gift Card if it suspects fraudulent activity.

8. Pilgrim Packs is not liable for any lost or stolen Gift Cards.
